§2 scope
2.1. These general terms and conditions (hereinafter also referred to as "GTC" for short) from Madame Tussauds Austria GmbH (hereinafter "Madame Tussauds") apply to the ordering of tickets from the range offered by "Madame Tussauds" in your online shop Version valid at the time of order.
2.2. By ordering in the online ticket shop, the customer accepts these terms and conditions.
2.3. Should individual regulations of these terms and conditions contradict the statutory regulations in whole or in part, the remaining regulations of these terms and conditions will still remain valid.
2.4. An order is only possible if all mandatory fields (fields marked with an asterisk) have been filled out. Before completing the order, customers receive a summary of the content of the order including prices, which can still be corrected or confirmed.
§3 Conclusion of the contract
By clicking on the “Order ticket” button, the customer makes an offer to conclude an online ticket contract with “Madame Tussauds”, which “Madame Tussauds” can accept by sending a confirmation email.
§4 payment
Payment can be made by instant bank transfer, credit cards, PayPal and eps. The order process is completed by entering the payment details and confirming the “Order ticket button”.
§5 Delivery of the admission tickets
For admission tickets bought online, you will receive an e-ticket, which you have to show when you visit “Madame Tussauds” at the cash desk and will be issued with a corresponding ticket.
§6 prices
The prices for online tickets correspond to the currently valid price lists or the information in the online ticket shop.
Individual interested parties can only purchase discount tickets in the online ticket shop if they belong to one of the groups of beneficiaries. Only one ticket is issued per prospect. The discount tickets are invalid without a photo ID justifying the preferential treatment or without reaching the minimum group size.
§7 Warranty and Liability
The statutory liability provisions apply.
§8 complaints
"Madame Tussauds" has not submitted to any out-of-court complaint or legal remedy procedures.
§9 privacy policy

§10 right of withdrawal
10.1. Right of withdrawal for admission tickets for a specific date or for a specific period of time:
In accordance with Section 18 (1) Zi 10 FAGG, the customer has no right to withdraw from an admission ticket valid for a specific date or for a specific period. The customer's right of withdrawal also expires if the customer has redeemed the ticket before the end of the first withdrawal period.
10.2. Right of withdrawal in other cases:
In all other cases, the customer has the right to withdraw from this contract for the purchase of admission tickets that have not been redeemed before the withdrawal period and are not valid for a specific date or for a specific period within 14 days without giving reasons. The withdrawal period is 14 days from the day on which the customer received the admission ticket by email.
10.3. General information on the right of withdrawal:
In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or email). You can use the following sample withdrawal form for this purpose, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification that you are exercising your right of withdrawal to the following address before the withdrawal period has expired:

10.4. Consequences of resignation:
If the customer cancels the concluded contract, "Madame Tussauds" will deactivate the barcode of the admission ticket and must repay all payments that Madame Tussauds has received from the customer immediately and at the latest within 14 days from the date on which the notification of the cancellation of this contract has been received by “Madame Tussauds”. For this repayment, "Madame Tussauds" uses the same means of payment that the customer used in the original transaction, unless something else was agreed with the customer; In no case will the customer be charged fees for this repayment.
§11 Copyright Regulations
The copyrights to the materials contained on this website and any Madame Tussauds trademarks belong to Madame Tussauds. Copying of material from this website is permitted under the following conditions:

• Any copies must contain copyrights or other understandable references to the owner of the original material;

Deliveries and declarations of intent are made in writing to the email address given by the customer in the order until a different email address is given. The customer is obliged to provide the relevant data requested in the contract completely and correctly when concluding the contract.
§13 Applicable law / place of jurisdiction
Exclusive Austrian law applies, the place of jurisdiction is the factually and locally competent court for Vienna, unless mandatory statutory provisions stipulate a different place of jurisdiction.
§14 Covid-19
Safety measures
In response to the Covid-19 pandemic, we have implemented specific safety measures at each of our attractions to ensure the health, safety and wellbeing of those visiting our attractions.

Requirements for visitors
The security measures that have been put in place in response to the Covid-19 pandemic are designed to ensure the safety and well-being of all guests who visit our attraction. It is in the interest of all visitors to our attraction to comply with the safety measures introduced. Should a person fail to adhere to these safety measures, we therefore reserve the right to require that person to leave the attraction in accordance with these conditions.
Acceptance of the risk
The safety measures that are and have been put in place are intended to minimize the risk of contracting the Covid-19 virus, but this risk cannot be completely eradicated. Therefore, everyone who visits our attractions recognizes that they do so at their own risk.

What these Terms cover
These are the Terms and conditions on which you licence to the Madame Tussauds Wien, its subsidiaries, affiliates, licensees, its subcontractors, consultants and agents including without limitation Merlin Entertainments Limited (company number 08700412) (referred to as "Madame Tussauds Wien", "we" or "us") the use of the respective image and material (including photographs, audio and video material) (Content), which is owned or licensed by you in whatever medium or form and where we asked you if we could use the respective Content by commenting your Content.
Term of this licence
This licence shall commence on the date that you indicate your acceptance of these Terms by replying to our comment referencing these Terms with the hash tag [#yesTussaudsWien, #yesTussaudsVienna], agreeing to Madame Tussauds Wien's use of the Content, after Madame Tussauds Wien asked you for using your Content and acceptance of these Terms.
Grant of licence
In consideration of Madame Tussauds Wien displaying your Content on a website connected with Madame Tussauds Wien or any other website promoting Madame Tussauds Wien or posts on social media channels associated with Madame Tussauds Wien with that purpose, you hereby unconditionally and irrevocably grant to Madame Tussauds Wien, a perpetual, non-exclusive, fully-transferable, royalty-free , worldwide, sub-licensable licence to use, copy, reproduce, modify, transmit, publish, edit, display and make derivative works of the Content on any media now known, or hereafter developed , in formats and contexts for any purpose for the promotion of the service or related business activities of the Madame Tussauds Wien and the right to make commercial use of the Content and excerpts of the Content in advertisements for, and in marketing and promotional materials related to, the Madame Tussauds Wien (the "Licensed Rights").

Which country's laws apply to any disputes?
The law of the Federal Republic of Germany shall apply for these Terms to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The statutory provisions on the restriction of the choice of law and on the applicability of mandatory provisions, in particular of the state in which you have your habitual residence as a consumer, shall remain unaffected.
Consent
Subject to the below, you have the right to withdraw your consent to the use of your Content at any time with effect for the future. If you wish to withdraw consent, please contact the email address in the Contact and Complaints clause below.
You acknowledge that whilst you can withdraw your consent and prevent the use of your Content in future projects, it may not be possible for your Content to be completely removed from some materials, including but not limited to, physical marketing materials already in circulation. Furthermore, please note that this only affects the use of material on which you are recognizable or which otherwise contains your personal data. The transfer of the rights of use under copyright law remains unaffected by such a withdrawal.
